Our Mandate

Constitutional Mandate the Department of Economic Development, Environment and Tourism (LEDET) draws its service delivery mandate from the Constitution of the Republic of South Africa (1996), which is the supreme law of the country. The Constitution makes provisions for enactment of other legislations. Section 24(a) and (b) of the Constitution (1996: 11) states that everyone has the right: a) to an environment that is not harmful to their health or well-being, and b) to have the environment protected, for the benefit of present and future generations through reasonable legislative and other measures that (i) prevent pollution and ecological degradation, (ii) promote conservation; and (iii) secure ecologically sustainable development and use of natural resources while promoting justifiable economic and social development. Further the Department is constitutionally mandated to facilitate and promote economic growth and development in accordance with Part A of Schedule 4 and 5 of the Constitution (ibid) pertaining to the following functional areas of concurrent national and provincial legislative competence: i) Casinos, racing, gambling and wagering; ii) Consumer protection; iii) Administration of indigenous forests; iv) Environment, v) Nature conservation, excluding national parks, national botanical gardens and marine resources; vi) Pollution control, vii) vii) Industrial promotion; viii) Provincial public enterprises; ix) Trade; x) Tourism; and xi) Liquor licenses.
